Nicole Curtis’ child custody disputes with her ex-husband

San Jose residents who watch the HGTV show ‘Rehab Addict” may be familiar with Nicole Curtis. The 40-year-old is involved in a custody battle over her 1-year-old son with her ex-boyfriend, 54-year-old Shane Maguire. After their son was born in 2015, Maguire filed a paternity complaint to prove that he was the father, and Curtis petitioned the court for a child support order.

Curtis and Maguire have gone before a family court judge several times after the initial child support and child custody orders were issued. The parents have fought over the issue of keeping their case sealed from the public record, Curtis has accused Maguire of bad parenting, and Maguire has alleged that Curtis interfered with the child custody arrangement.

Shortly after Curtis and Maguire’s son celebrated his 1st birthday, a judge granted the ex-couple joint custody of the boy. However, Maguire was only allowed to have parenting time on the weekends. Curtis was granted permission to move from Minnesota to California with her son, and she was ordered to split the cost of her son’s weekend traveling expenses with Maguire. Maguire and Curtis fought over one weekend that Maguire wasn’t able to see his son. Maguire claimed that Curtis interfered with the custody order, but Curtis claimed that the boy couldn’t travel due to an ear infection.

Sharing parenting time can become very complicated when divorced parents do not communicate well with each other. There are many cases where one or both parents will file complaints against each other over parenting issues that could be resolved in private negotiations.
